Citizens Elated; Mantri suffers two legal setbacks

Citizens of Koramangala, HSR Layout and Bellandur were elated to hear that the Supreme Court, in the appeal filed in the Shashi Distilleries matter, has quashed the order of the High Court of Karnataka staying proceedings in the NGT Principal Bench, Delhi on the Bellandur Foaming matter.
The Supreme Court has also expressed anguish at the strange decision of the High Court of Karnataka and the manner in which it has sought to interfere with the work of another judicial body. The decision will also affect Mantri Techzone P Ltd who had filed a case in the High Court seeking to exploit the earlier High Court order.
The NGT will now assume full control of the matter.
Mantri Techzone P Ltd has also lost its case in the Supreme Court asking for a stay on the revised buffer norms. When the case came up for hearing on Friday, 11th August, the bench headed by Chief Justice of India, Dipak Misra, told the lawyer for Mantri Techzone that the case would need to be withdrawn otherwise the bench would dismiss the case with orders. Mantri’s lawyers agreed on the spot to withdraw the case and the matter has been treated as “dismissed as withdrawn”.
The Supreme Court has thus clearly expressed its reluctance to interfere with the NGT orders on the case and this clearly indicates that the case can now be fasttracked by the NGT.
