High Court Notice to BBMP over Eatery

On Friday 24th July in the High Court of Karnataka, the Division bench headed by the Chief Justice admitted a petition filed by the Koramangala 3rd block Residents’ Welfare Association against the Bruhat Bangalore Mahanagara Palike (BBMP) and the illegal eatery calling itself “154 Breakfast Club” functioning from 8th Main Road in the residential zone.
Hearing the plea filed by Koramangala 3rd Block Residents’ Welfare Association, the division bench of acting Chief Justice Subhro Kamal Mukherjee and Justice B V Nagarathna issued notice to the respondents.
Notices have been issued to BBMP Bangalore Development Authority (BDA) and M/s Hivemind Cafe and Studios which runs the restaurant.
The petitioner contended that giving licence to the eatery was in violation of an order of the High Court relating to Comprehensive Development Plan and also the change of land use regulations under Karnataka Town and Country Planning Act, 1961. Also it contended that the BBMP had violated Zonal Regulations and Comprehensive Development Plan 2015 in issuing a trade licence on November 19, 2014 to M/s Hivemind Cafe and Studios to open ‘154 Breakfast Club’ at 8th Main, 3rd Block in Koramangala.
Readers will recall that one of the partners of this establishment is the son of  TV Mohandas Pai and that the Koramangala 3rd Block RWA  had claimed compelling evidence to show that laws were bent by the BBMP and its former Commissioner Lakshminarayan to favour this particular establishment.
What exactly compelled the former commissioner to direct giving a license which was forbidden specifically by law and what exactly compelled Pai who is known for public stands extolling probity in public life, to take a U-turn from his professed stands in this particular case are the questions that Koramangala residents are demanding answers to.
RWA office bearers when contacted expressed their confidence that the law will now take its course.
